Percussion Software, Inc. (“Percussion” or the “Company”) is committed to help protect the privacy of individuals (“Visitors”) who visit Percussion’s web sites (“Sites”) and individuals and companies (“Customers”) that register to use our software or services (collectively “Software”). This privacy statement explains Percussion’s privacy practices in relation to the use of Sites and the data collection and use practices for the information and/or reports that will be sent to Percussion as a result of your use of Percussion’s Software.
Percussion may collect certain information from you as described below. Percussion uses information it collects for various purposes, which may include authentication, fulfillment of your requests for products and services, and to communicate with you regarding Percussion services.
Log Files/Browser Information: Every time you visit an Internet location page on the Internet, your Web browser sends information to the Web site you are visiting. Percussion servers automatically collect and store this information. We may associate this information with your personal information to resolve technical issues and promote security.
Percussion may disclose personal information or information regarding the use of its Sites if, for any reason, in our sole discretion, we believe that it is necessary to do so in order to satisfy laws, regulations, or other legal requests for such information; to cooperate with law enforcement agencies; to disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Terms of Use or other policies; to protect Percussion, our services, our employees, or our users; or in connection with a proceeding, transaction or proposed transaction involving the transfer of the business or assets to which the information pertains.
We may provide links to other third party web sites. Percussion is not responsible for the privacy policies and/or practices of any other third party or any service or product they may provide.
Users who no longer wish to receive Percussion email updates or notifications may opt-out of receiving these communications following the instructions contained in the applicable email. If you choose not to provide the information we request, you can still visit most of the Sites, but you may be unable to access certain options, offers, and services.
Percussion takes reasonable precautions to protect your information. We use reasonable measures to protect Customer and Visitor information that is stored within our database, and we restrict access to Customer and Visitor information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff.
When you use the Software, basic information about you use the Software, including compliance with use limitations, is collected and sent to Percussion on a periodic basis. However, Percussion does not store any personal information. In addition to ensuring compliance with license restrictions, this information will help us improve the features our customers use most often and to create solutions to common problems. Information that Percussion may gather includes, but is not limited to the following: number of sites published, number of pages published, API calls, web traffic, page views, storage usage, bandwidth usage, and compute resources. Percussion may gather additional information, and you can always check this privacy statement, as may be updated from time to time, in order to determine what information is currently gathered by Percussion. If you do not wish Percussion to gather the information through the functionality of the Software, you must not install and use the Software.

In addition, standard computer information typically includes certain information about your computer software and hardware, such as your IP address, operating system version, web browser version, your hardware ID (which indicates the device manufacturer, device name, and version), and your regional and language settings. Although when a report is sent to Percussion, standard computer information is sent as well, Percussion does not store your IP address with the reports.
This information is sent to Percussion when you are connected to the Internet, and will identify you based on the information you submit when you. Percussion may use the information to improve its software and identify trends and usage patterns. We may share the information with our affiliates. No information is used or shared for advertising purposes.
Information that is collected by or sent to Percussion may be stored and processed in the United States or any other country in which Percussion or its affiliates, subsidiaries, or agents maintain facilities, where privacy laws may not be as protective as in your home country. By using the Software, you consent to the transfer, storage, use, and disclosure of information gathered, as described in this privacy statement, in the United States or any other country selected by Percussion. Percussion may disclose this information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Percussion or its site; (b) protect and defend the rights or property of Percussion, or (c) act in urgent circumstances to protect the personal safety of Percussion employees, users of Percussion software or services, or members of the public. Percussion occasionally hires other companies to provide limited services on its behalf, such as providing customer support, processing transactions, or performing statistical analysis of reports. Percussion will provide those companies only the information they need to deliver the service. They are required to maintain the confidentiality of this information and are prohibited from using it for any other purpose.
Percussion may occasionally update this privacy statement. When we do, we will also revise the "last updated" date at the top of the privacy statement. We encourage you to periodically review this privacy statement to stay informed about how we are helping to protect the information we collect.
